Terms & Conditions

1.1 Personal Use

The User agrees to use the Application solely for strictly personal purposes. Any use of the Application for commercial, promotional, electoral, recruitment activities, or for organizing gatherings or events is prohibited. It is also forbidden to send marketing, commercial, or advertising messages, including any content, information, or hyperlink redirecting to sites or media belonging to third parties, especially competitors of Florian Mlr, via the Application's messaging. Any violation of these obligations constitutes a major breach of these Terms and may result in Account termination, in accordance with the terms of this article.

2.1 User Account Security

When creating the account, the User is informed that their login credentials are personal and must not be shared under any circumstances.

The Account, personal and unique, is exclusively reserved for the concerned User. The possession of multiple accounts is strictly prohibited and constitutes a serious violation of the Terms. Login credentials must be kept confidential. The User is solely responsible for their use and security, and any activity conducted with their credentials is considered initiated by them.

2.2 Registration

To use the Application, it is essential to register and create a User Account. This registration is done from the login screen by selecting "Sign Up," allowing Florian Mlr to collect User information such as name, surname, gender, age (calculated based on date of birth), profile photos, and email address to complete their Profile.

2.3 Access to Application Features

Only Users who meet the criteria defined in Article 1 above and who have accepted these Terms can access the application's features. When creating the account, by clicking on "Sign Up," the User unreservedly approves all of the Terms, including the code of conduct outlined in Article 1.

These Terms are accessible at any time: in the application, under "Profile" then "Settings," or on the Lovzy website via the following link: https://lovzy.app/terms.html.

2.4 Account Monitoring and Management

To ensure compliance with the Terms, Florian Mlr uses various automated tools, as well as reports issued by Users, to monitor account activities and shared content. If an account appears to be in violation of the Terms, particularly regarding the conduct rules listed in section 6, Florian Mlr may temporarily suspend the account to verify the situation. Additional information may be requested from the concerned User, such as the associated phone number or email, to confirm their identity.

In the event of a confirmed violation, Florian Mlr is authorized to delete the offending account and to restrict the User's access to the application. Florian Mlr may also restrict or block an Account without prior notice in case of non-compliance with the Terms, including IP blocking. For EU Users, Florian Mlr informs of any action taken, unless an authority opposes it. For other Users, these measures may be applied without prior notification.

If a User believes that a decision against them is unfounded, they can appeal by following the instructions provided in the application or by contacting Florian Mlr at: contact@lovzy.app. EU residents also have the following recourses, in relation to the Digital Services Act: out-of-court remedy, appeal to the courts of their Member State, and the option to file a complaint with their national authority.

2.5 Protection Against Unwanted or Fraudulent Emails

The User agrees to be vigilant regarding fraudulent or unwanted emails allegedly sent by Florian Mlr. In case of receiving such a message, the User is advised to take precautions and immediately report these fraud attempts to Florian Mlr by mail or email at the addresses indicated in Article 15 of the Terms.

3.1 Your Content

Your profile must align with the intended use of our services and must not contain any prohibited content. You should not include personal contact information, bank details, or peer-to-peer payment information (such as addresses, phone numbers, email addresses, URLs, or bank card details) for yourself or others. If you choose to share personal information with other users, you do so at your own risk, and we strongly advise caution.

As your profile is visible globally, ensure that you are comfortable with the public sharing of your content. You acknowledge that other users may view and possibly share your content with third parties. By publishing your content, you warrant that you have the necessary rights and automatically grant us a license to use it.

We may provide tools to enhance your content or that of other members, allowing you to create or improve your posts. However, this content remains yours, and you are responsible for its accuracy and any potential consequences of its use. We reserve the right to monitor, modify, delete, restrict, or block access to your content at our discretion, though we have no obligation to publish or review it.

You are solely responsible for your content and must ensure that you do not share anything that could violate these Terms or expose yourself or us to legal risks. You agree to indemnify, defend, and hold us harmless from any claims or disputes related to your content. You confirm that all information you provide is accurate and agree to update it as necessary.

3.2 Member Content

Content posted by members remains the property of the user who uploaded it and may only be used in accordance with these terms. Although you have access to other members' content, you are not permitted to copy or use it beyond the limitations of our services.

The accuracy of member content should be independently verified, as some information may be biased, incorrect, or inappropriate. Each user is fully responsible for their own content and any actions resulting from it. You do not hold any ownership rights to other members' content and may only use it within the scope of our services' purposes. Any inappropriate use, particularly for commercial purposes, harassment, or threats, may result in account suspension or deletion.

3.3 Our Content

All other content on our services is owned by or licensed to Lovzy. This includes text, graphics, trademarks, logos, sounds, illustrations, images, and other intellectual properties protected by copyright and trademark laws. Ownership of our content remains with us at all times. We grant you a limited license to access and use our content per Article 1 above, reserving all remaining rights.

3.4 Reporting Unlawful Content

Any Content that violates these Terms may be reported by any User to Florian Mlr using the tab located: At the top left of the concerned User's Profile; or At the top right of the conversation with the concerned User. The User whose Content is reported will not be informed of the identity of the person who reported them. If reported Content is deemed to constitute an offense under applicable laws and regulations, the User affected by this Content may also be encouraged to contact the competent authorities. In accordance with Law No. 2004-575 of June 21, 2004, for confidence in the digital economy, any person who presents Florian Mlr with Content or activity as being unlawful to obtain its removal or halt its dissemination, while knowing this information to be false, risks a penalty of one year in prison and a fine of EUR 15,000.

3.5 Blocking Another User

Aside from the reporting procedure described in Article 3.4 above, Users have the option to block any User whose behavior does not adhere to standards of decency. Blocking a User stops all communication with this person, mutually preventing access to Profiles and Messages, whether previously sent or future.

4.1 Uninstalling the Application

The User may uninstall the Application from their smartphone or tablet at any time, without notice. Uninstalling the Application, even without prior account logout, does not make the Profile invisible to other Users; it remains accessible for both past and future interactions. If the Application is reinstalled after a one-year period, the User will need to register again under the same conditions as an initial registration, as described in Article 2.2 above.

Uninstalling the Application does not terminate the current Subscription.

4.2 User Account Deletion

The User may permanently delete their Account at any time by accessing the "My Personal Data" menu (on the "Profile" page) and then "Delete my account" in the Application.

When the Account is deleted, the User's Profile is permanently removed and becomes invisible to other Users. As Lovzy uses temporary cache to reduce data consumption and allow offline access to the app, the profile may remain visible on some Users' devices.

All User data is permanently deleted, including:

• Quiz answers
• Conversations and their messages
• Profile data
• Any other additional information

Deleting the Account does not cancel or terminate ongoing Lovzy Premium Subscriptions. To terminate a Lovzy Premium Subscription, the User must manage their subscriptions via the App Store or Play Store, as indicated in Article 6.1 below.

Account deletion is permanent. To use the Application again, the User must re-register under the same conditions as an initial registration, in accordance with the provisions of Article 2.2 above.

5.1 Suspension or Deletion of Account for Violation of Terms

In case of suspected violation of these Terms, particularly the User Code of Conduct outlined in Article 1, the Account may be suspended at any time to allow for verification of the infraction. If the violation is confirmed, Florian Mlr reserves the right to delete the relevant Account by right, which will also result in the User being banned from the Application. As part of this verification, Florian Mlr may request necessary information from the User to assess compliance with the Terms and Code of Conduct, including personal information such as the phone number or email address associated with the Account, in order to authenticate the User. Account deletion entails the consequences detailed in Article 4.2.

No refunds for Subscriptions or other paid features will be granted.

5.2 Deletion of Account for Irreparable Violation of Terms

If a violation of the Terms is deemed irreparable, Florian Mlr may, after notifying the User, delete their Account by right. Account deletion results in the effects outlined in Article 4.2.

5.3 Deletion of Inactive Accounts

Any Account that remains inactive for a continuous period of one year is subject to deletion. An Account is considered inactive if both of the following criteria are met: The User's Application has not connected with Lovzy servers; The User has not used the Application. In this case, the User will be informed of the Account deletion with 30 days' notice via push notification, email, or SMS. Account deletion results in the consequences as detailed in Article 4.2.

6.1 EXTERNAL SERVICE PURCHASES AND SUBSCRIPTIONS

If you choose to make an external service purchase, including subscriptions, it must be managed through your external service account, which will continue to be billed periodically until canceled.

When you make a purchase through an external service (such as an Apple ID or Google Play), your external service account will be billed as indicated at the time of purchase, in accordance with the terms of your external service account. External services may also charge a sales tax depending on your location.

If you purchase an auto-renewing subscription through an external service, the subscription will renew at the same rate for each term unless you cancel. Promotional offers may affect renewal prices, which may increase after the initial period, as specified in the promotion terms.

To cancel a subscription: If you do not want automatic renewal or wish to modify your subscription, you must manage it directly through your External Service Account (even if you delete the Lovzy account or app). For example, Apple ID subscribers must cancel through Apple, not Lovzy. You can cancel via the app settings or by contacting Apple support. Google Play subscribers can cancel by accessing Google Play settings on their device or seeking help via Google Play support.

If you cancel, you can continue to use the service until the end of the current subscription period, after which the subscription will not renew.

If you initiate a chargeback or cancel a payment through your external service account, Lovzy may terminate your account at its discretion, assuming that you no longer wish to use a Lovzy subscription. If a chargeback or cancellation is later reversed, contact customer service. Lovzy will retain all billed funds until you officially cancel your subscription through your external service account. Some users may be eligible for a refund.

6.2 Right of Withdrawal

In accordance with the Consumer Code, the User has a period of 14 working days from the delivery date of their order to request a refund for unused paid Services, directly through the App Store or Play Store. Since payment for premium subscriptions is made through the App Store or Play Store, the User must exercise their right of withdrawal by notifying these platforms of their decision by sending the withdrawal form provided in Article R221-1 of the Code or any other clear statement expressing their desire to withdraw.

7.1 Access to Services

Florian Mlr strives to provide continuous access to the Services for Users with a compatible smartphone or tablet, as indicated in the Application's description on the App Store or Play Store, subject to force majeure events, events beyond its control, or necessary maintenance interventions for the proper functioning or improvement of the Services and the Application, which may be performed without prior notice to Users.

Each User is responsible for taking appropriate precautions to protect against any contamination of their data, software, or hardware by viruses that may be transmitted via the Application or published Content, and for managing backups of downloaded files.

The User expressly acknowledges and agrees that downloading any Content from another User via the Application is done at their own risk. They are solely responsible for any damage to their mobile device or other hardware and any data loss resulting from this download.

7.2 Hosting

Florian Mlr, as a content host, is not obligated to continuously monitor content posted by users of the Application. Its liability cannot be engaged for activities or information stored at the request of a user, unless it has actual knowledge of their manifestly illegal nature or if elements clearly indicate such illegality. In such cases, Florian Mlr will promptly take action to remove the content or restrict access to it.

The Application is made available without specific warranties, "as is." Florian Mlr disclaims any liability for any damages that may result from incompatibility between the Application and the user's specific needs or expectations.

Finally, the use of content accessible via the Application is entirely the responsibility of each user, who assumes the consequences of their choices and decisions. Florian Mlr cannot be held responsible.

7.3 Device Malfunction

The User is solely and exclusively responsible for their equipment, whether it be a phone, tablet, software, browser, modem, or any other device required to use the Application. Florian Mlr cannot be held responsible for any malfunction, of any nature, concerning the User's access devices to the Services.

1. Prohibition of Access to Minors

Our application is strictly reserved for individuals aged 18 and older. Users must confirm their age during registration, and we reserve the right to request supporting documents to verify their age.

2. Reporting and Blocking Tools

We provide users with intuitive tools to report any suspicious or inappropriate content or behavior. Every report is taken seriously and promptly reviewed by our moderation team. Users can also block any profile they find suspicious or dangerous.

3. Active Moderation

Our moderation team actively monitors platform activities to detect and respond to violations of our standards. Any activity involving harmful behavior or illegal content results in the immediate removal of the offending account and, if necessary, referral to the appropriate authorities.

4. Collaboration with Authorities and Organizations

We cooperate with local and international authorities to report any suspected cases of exploitation or abuse. We also actively support initiatives aimed at protecting minors online.

5. Zero-Tolerance Policy

Any user involved in inappropriate behavior, particularly targeting minors, will have their account suspended or deleted without prior notice. We reserve the right to report such cases to the relevant authorities.

6. Commitment to Continuous Improvement

We regularly evaluate our policies and practices to enhance our prevention measures and ensure the safety of all our users. Any user suggestions or concerns can be communicated to our team via contact@lovzy.app.

By using our application, users agree to adhere to these standards and contribute to creating a safe and welcoming environment. We are determined to take strong action to prevent and combat any form of child sexual abuse and exploitation.
